VALUATION OF INTELLECTUAL PROPERTY - LEGAL BASIS

Vietnam Intellectual Property Research Institute conducts industrial property assessment activities based on the following legal grounds:

- The Regulation on organization and operation of the Intellectual Property Research Institute was issued by the Minister of Science and Technology together with Decision No.1660 / QD-BKHCN dated August 13th, 2007 and No.178 / QD –BKHCN 10.02.2010 

- Joint Circular No.39/2014/TTLT-BKHCN-BTC dated December 17, 2014 issued by the Minister of Science and Technology detailing guidance on the valuation results of science and technology development research, intellectual property using the state budget.

- Circular No.06/2014/TT-BTC dated January 07, 2014 by Minister of Finance on Valuation standard No.13;

- Article 201 (Assessment of intellectual property) Law on Intellectual Property ;

- Chapter VI (Intellectual Property Assessment - Articles 39 to 53) Decree No.105/2006/ND-CP of September 22nd, 2006 for detailed guidance on the implementation of articles of the Law on Intellectual Property Rights and on State Management of Intellectual Property, amended under Decree No.119/2010/ND-CP of December 30th, 2010.

- Certificate of eligibility for industrial property assessment No.01 / CN-SHTT issued by the Director of Intellectual Property Department on June 17, 2009, to the Intellectual Property Research Institute. 

- Circular No.16/2014/TT-BKHCN dated June 13, 2014 of Minister of Science and Technology on requirements pertaining to establishment and operation of technology market intermediaries.
