ASSESSMENT OF INTELLECTUAL PROPERTY - LEGAL BASIS

Vietnam Intellectual Property Research Institute conducts industrial property assessment activities based on the following legal grounds:

- The Regulation on organization and operation of the Intellectual Property Research Institute was issued by the Minister of Science and Technology together with Decision No.1660 / QD-BKHCN dated August 13th, 2007 and No.178 / QD –BKHCN 10.02.2010 

- Article 201 (Assessment of intellectual property) Law on Intellectual Property 

- Chapter VI (Intellectual Property Assessment - Articles 39 to 53) Decree No.105/2006/ND-CP of September 22nd, 2006 for detailed guidance on the implementation of articles of the Law on Intellectual Property Rights and on State Management of Intellectual Property, amended under Decree No.119/2010/ND-CP of December 30th, 2010.

 - Circular No.01/2008/TT-BKHCN dated February 25th, 2008, amended following Circular No.04/2009/TT-BKHCN dated March 27th, 2009, guiding the issuance and revocation of industry property assessor cards and certificate of eligibility for industrial property assessment. 

- Certificate of eligibility for industrial property assessment No.01 / CN-SHTT issued by the Director of Intellectual Property Department on June 17, 2009, to the Intellectual Property Research Institute.
